Resignation

Resignation occurs where an employee initiates the termination of his/her employment. The conditions under which employees can do this while still retaining their contractual rights should be set out in the terms and conditions of employment.

These should state:

  • The length of notice an employee is required to give the employer of his/her intention to leave. If this is not stated then the statutory requirement of one week should be observed.
  • The person to whom the notice should be given: an employee's supervisor, personnel department or the head of the organisation
  • The manner in which notice should be given: either verbally or in writing
